Terms and Conditions of Accommodation

Article 1 Scope of Application 1-1. The accommodation contracts and any related contracts entered into by this hotel with its guests shall be governed by the provisions of these Terms and Conditions; matters not provided for herein shall be governed by laws and regulations (meaning laws or regulations based on laws; the same shall apply hereinafter) or generally established customs 1-2. Where this hotel agrees to a special arrangement to the extent that it does not contravene laws, regulations or customary practice, such special arrangement shall take precedence, notwithstanding the provisions of the preceding paragraph. 1-3. All dates, times, deadlines, the starting points for the calculation of periods, and other time-related criteria set out in these Terms and Conditions shall be based on Japan Standard Time (JST). Article 2 Application for an Accommodation Contract 2-1. Any person wishing to apply for an accommodation contract with this hotel must provide the following information to this hotel. i. Guest’s Name ii. Dates of stay and estimated time of arrival iii. Accommodation charges (As a general rule, these are based on the basic accommodation rates set out in Appendix 1.) iiiv. Any other matters deemed necessary by the hotel 2-2. If a guest requests to extend their stay beyond the number of nights specified in paragraph (i) above during their stay, the Hotel shall treat this request, at the time it is made,as an application for a new accommodation contract. Article 3 Conclusion of Accommodation Contracts, etc. 3-1. The accommodation contract shall be deemed to have been concluded when the Hotel accepts the application referred to in the preceding clause. However, this shall not apply where it is proven that the Hotel did not give its acceptance. 3-2. Where an accommodation contract is concluded in accordance with the provisions of the preceding paragraph, you shall pay a deposit, as determined by this hotel, not exceeding the basic accommodation charge for the period of stay,by the date specified by this hotel. 3-3. The booking deposit shall first be applied towards the accommodation charges ultimately payable by the guest; should circumstances arise in which the provisions of Articles and apply, it shall be applied first towards any penalty charge and then towards any compensation payable; any remaining balance shall be refunded upon payment of the charges in accordance with the provisions of Article . 3-4. Should the booking deposit referred to in paragraph not be paid by the date specified by this hotel in accordance with the provisions of that paragraph, the accommodation contract shall cease to be valid. However, this shall apply only where this hotel has notified the guest of the due date for payment of the booking deposit. Article 4 Special clause exempting the payment of a deposit 4-1. Notwithstanding the provisions of paragraph 2 of the preceding article, the Hotel may agree to a special arrangement whereby the deposit referred to in that paragraph is not required following the conclusion of the contract. 4-2. Where, in accepting an application for an accommodation contract, this hotel has not requested payment of the deposit referred to in paragraph 2 of the preceding article, or has not specified a due date for such payment, the matter shall be treated as having been agreed in accordance with the special terms set out in the preceding paragraph. the matter shall be treated as having been agreed in accordance with the special terms set out in the preceding paragraph. Article 4-2 Request for cooperation with infection prevention measures This hotel may request that guests seeking accommodation cooperate by providing reports on medical diagnoses, remaining in their rooms, and confirming their state of health. Article 5 Refusal to Enter into an Accommodation Contract The Hotel may refuse to enter into an accommodation contract in the following circumstances. However, this clause does not imply that the Hotel may refuse accommodation in circumstances other than those set out in Article of the Hotel Business Act. 5-1. Where a booking for accommodation is not made in accordance with these terms and conditions. 5-2. When there are no rooms available due to the hotel being fully booked. 5-3. Where it is deemed that a person seeking accommodation is likely to engage in conduct in relation to their stay that contravenes the provisions of laws and regulations, public order or public morals. 5-4. Where a person seeking accommodation is deemed to fall under any of the following points i. to iii. i. Organised crime groups as defined in Article 2(2) of the Act on the Prevention of Unlawful Acts by Organised Crime Group Members (Act No. 77 of Heisei 3) (hereinafter referred to as ‘organised crime groups’), members of organised crime groups as defined in Article 2(6) of the same Act (hereinafter referred to as ‘organised crime group members’), quasi-members of organised crime groups, persons associated with organised crime groups, and other anti-social forces ii. Where a corporation or other organisation is controlled in its business activities by a criminal organisation or a member of such an organisation iii. A corporation in which any of its directors is a member of an organised crime group 5-5. Where a person intending to stay at the accommodation engages in conduct that causes significant inconvenience to other guests. 5-6. Where a person seeking accommodation is a patient with a specified infectious disease, etc. 5-7. Where violent demands are made in connection with accommodation, or where services or burdens exceeding reasonable limits are demanded (except where a person seeking accommodation requests the removal of social barriers). 5-8. Where a person intending to stay at this hotel makes demands of the hotel that are difficult to fulfil, such as those that would impose an excessive burden on the hotel and are likely to significantly impede the provision of accommodation services to other guests, or repeatedly engages in abusive behaviour or other conduct that places a physical or mental strain on staff. 5-9. Where accommodation cannot be provided due to natural disasters, facility breakdowns or other unavoidable circumstances. 5-10. Furthermore, where the circumstances fall within the cases in which accommodation may be refused as stipulated by various laws and regulations or prefectural ordinances, etc. 5-11. Where it is determined that a person intending to stay at the hotel has, during a previous stay at a hotel within this hotel group, engaged in any of the acts specified in the various paragraphs of Article or in conduct not in accordance with these Terms and Conditions. Article 5-2 Explanation of the refusal to enter into an accommodation contract Any person wishing to stay at the hotel may request the hotel to explain the reasons why it has refused to enter into a contract of accommodation pursuant to the preceding article. Article 6 Guests’ right to cancel their booking 6-1. Guests may cancel their accommodation contract by notifying the hotel. 6-2. Should a guest cancel all or part of the accommodation contract for reasons attributable to the guest (excluding cases where, pursuant to the provisions of Article 3, paragraph 2, the Hotel has specified a due date for payment of the booking deposit and requested such payment, and the guest cancels the accommodation contract prior to that due date), the Hotel shall charge a cancellation fee in accordance with the provisions set out in Appendices 2 and 3. However, where the Hotel has agreed to a special provision under Article 4, Paragraph 1, this shall apply only where, at the time of agreeing to such special provision, the Hotel has notified the guest of the obligation to pay a penalty in the event of cancellation of the accommodation contract by the guest. 6-3. Should a guest fail to arrive by the time the reception closes on the day of their stay (or by the specified arrival time, if one has been provided) without giving prior notice, the hotel may treat the accommodation contract as having been cancelled by the guest. Article 7 The Hotel’s Right to Terminate the Contract The Hotel may terminate the accommodation contract in the following circumstances. However, this clause does not imply that the Hotel may refuse accommodation in circumstances other than those set out in Article of the Hotel Business Act. 7-1. Where it is deemed that a guest may engage in conduct in connection with their stay that contravenes statutory provisions, public order or public decency, or where it is deemed that the guest has engaged in such conduct. 7-2.宿泊客が次のi.からiii.に該当すると認められるとき。i. Where violent demands are made in relation to accommodation, or where a burden exceeding reasonable limits is imposed (except where a guest requests the removal of social barriers). 7-6. Where a guest makes repeated demands of the Hotel that are difficult to fulfil, such as those which would impose an excessive burden on the Hotel and are likely to significantly impede the provision of accommodation services to other guests, or engages in repeated abusive behaviour or other conduct that places a physical or mental strain on staff. 7-7. Where accommodation cannot be provided due to natural disasters, facility breakdowns or other unavoidable circumstances. 7-8. Where the circumstances fall within the cases in which accommodation may be refused as stipulated by various laws and regulations or prefectural ordinances, etc. 7-9. Smoking within the premises, tampering with fire-safety equipment, or failure to comply with other prohibited acts set out in the hotel’s terms and conditions (limited to those necessary for fire prevention). 7-10. Where it is clearly established that a guest has, without the hotel’s permission, carried out filming or similar activities for commercial purposes. Should this hotel terminate the accommodation contract in accordance with the provisions of this clause, a penalty charge will be levied as set out in Appendices and . Article 7-2 Explanation of the Cancellation of the Accommodation Contract A person intending to stay at the hotel may request the hotel to explain the reasons if the hotel terminates the accommodation contract in accordance with the preceding article. Article 8 Accommodation Registration On the day of their stay, guests are required to register the following details at the hotel reception, in accordance with the laws and regulations governing the hotel industry and the guidance issued by the relevant authorities. 8-1. Guests’ names, ages, genders, addresses and contact details 8-2. For foreign nationals who do not have an address in Japan: nationality, passport number, and date of entry 8/3. Any other matters deemed necessary by the hotel Where a guest intends to pay the charges specified in Article using a voucher, credit card or other means that may be used in lieu of currency, they must, in advance,present such means at the time of registration referred to in the preceding paragraph. Article 9 Room usage times 9-1. Guests may use the hotel’s guest rooms from the check-in time specified by the hotel until the check-out time. However, in the case of consecutive nights’ accommodation, guests may use the rooms throughout the day, except on the day of arrival and the day of departure. 9.2. Notwithstanding the provisions of the preceding paragraph, the Hotel may accommodate requests for the use of guest rooms outside the hours specified in that paragraph. In such cases, you will be required to pay an additional charge (including consumption tax) as determined by the Hotel. Article 10 Compliance with the Terms of Use 10-1. Guests are required to comply with the rules of use established by the hotel and displayed on the premises whilst staying at the hotel. 10.-2 Outside reception opening hours, we regret that we cannot permit non-resident visitors to remain on the premises. Furthermore, should it be discovered that external visitors are staying on the premises outside of these hours, we will impose a penalty fee as stipulated by the hotel, even if the number of pre-booked guests falls short of the maximum capacity. Additionally, should a guest’s use of the hotel for purposes other than those intended, or conduct contrary to public order and morals, pose a risk of damaging the hotel’s reputation, the guest must, upon request by the hotel, take measures such as ceasing such use orconduct. Article 11 Opening Hours 11-1. The opening hours for the hotel’s main facilities are as follows; detailed opening hours for other facilities are provided in the brochures available on site, on notices displayed in various locations, and in the service directory in your room. Reception Opening Hours 10:00 〜 21:00 Check-in 〜 21:00 Check-out 〜 10:00 11-2. The times specified in the preceding paragraph are subject to change at short notice. In such cases, we will notify you by appropriate means. Article 12 Payment of Fees 12-1. The breakdown of accommodation charges and other fees payable by guests is set out in Appendix . 12-2. Payment of the accommodation charges and other fees referred to in the preceding paragraph must be made in cash, by credit card or by any other method specified by the hotel. 12-3.当ホテルが宿泊客に客室を提供し、使用が可能になったのち、宿泊客が任意に宿泊しなかった場合においても、宿泊料金は申し受けます。Article 13 The hotel’s liability 13-1. In the event that the Hotel causes damage to a guest in the course of performing an accommodation contract or any related contract, or as a result of a breach thereof, the Hotel shall pay compensation up to a maximum of , yen (except where such damage is caused by the Hotel’s wilful misconduct or gross negligence). However, this shall not apply where the damage is not attributable to the Hotel. 13-2. This hotel holds accommodation liability insurance to cover any eventualities, such as fire. Article 14 Procedures to be followed when a booked room cannot be provided 14-1. Should the Hotel be unable to provide a guest with the room for which a booking has been made, it shall, with the guest’s consent, arrange for alternative accommodation under conditions that are as similar as possible. 14-2. Notwithstanding the provisions of the preceding paragraph, should this hotel be unable to arrange alternative accommodation, it shall pay the guest compensation equivalent to the amount of the penalty charge, and such compensation shall be set off against the amount of damages. However, no compensation shall be paid if there are no grounds attributable to this hotel for the failure to provide a guest room. Article 15 Storage of guests’ luggage or personal belongings 15-1. Should a guest’s luggage arrive at the hotel prior to their check-in, the hotel will store it safely only if prior approval has been granted by the hotel, and it will be handed over to the guest at reception when they check in during reception opening hours. Please use the in-room safe at your own risk; the hotel accepts no liability whatsoever for the theft or loss of valuables. 15-2. In the event that a guest’s luggage or personal belongings are left behind at the hotel after check-out, the hotel will, as a general rule, not contact the guest directly, but will act in accordance with any contact or instructions received from the owner. Cash and precious metals will be held for seven days, including the day of discovery, after which they will be handed over to the nearest police station; all other items will be disposed of after a seven-day retention period. However, for food and drink, for hygiene reasons, upon discovery during post-check-out cleaning or at any other time the hotel discovers such items, the hotel shall, at its discretion, as a general rule, dispose of them immediately. Article 16 Guests’ Responsibilities Should the Hotel suffer any loss or damage as a result of a guest’s wilful act or negligence, the guest in question shall be liable to compensate the Hotel for such loss or damage. Article 17 Amendments to the Terms and Conditions These Terms and Conditions of Accommodation may be amended at the Hotel’s discretion. Any amendments to these Terms and Conditions of Accommodation shall take effect from the date specified at the time of publication, once the amended provisions have been posted on the website designated by the Company. Furthermore, these Terms and Conditions of Accommodation shall be made available for guests to view at all times within their guest rooms. Article 18 Disclaimer Guests shall use the internet at this hotel at their own risk. Should internet access be interrupted due to a system failure or any other reason whilst a guest is using the internet, and should the guest suffer any loss or damage as a result, this hotel shall not be held liable in any way. Furthermore, should this hotel or a third party suffer any loss or damage in connection with a guest’s use of the internet, the guest shallcompensate this hotel or the third party for such loss or damage. Article 19 Dispute Resolution and Governing Law Any and all disputes arising between guests and this hotel in relation to the accommodation contract shall be governed by the laws of Japan, and the Tokyo District Court shall be the exclusive agreed court of first instance.
